MORTGAGE FORECLOSURE SALE. Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Sherry S. Spivey, unmarried, originally in favor of U.S. Small Business Administration, on June 6, 1998, said mortgage recorded in the Office of the Judge of Probate of Covington County, Alabama, in Book 952, Page 263, and reformed by Court Order recorded in Real Prop Book 2016, Page 357; the undersigned U.S. Bank National Association, as Trustee, successor in interest to Wachovia Bank, National Association, as Trustee for Bayview Asset-Backed Securities, Series 2005-11, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Andalusia, Covington County, Alabama, on December 20, 2021, during the legal hours of sale, all of its rights, title, and interest in and to the following described real estate, situated in Covington County, Alabama, to-wit: For a point of beginning of the lands herein described: Commence at an iron pin at the accepted Northeast corner of Southwest quarter of Southeast quarter of Section 30, Township 5 North, Range 15 East; thence run South 00 Degrees 00 minutes West for a distance of 123.9 feet to a point on the South side of a field road and the point of beginning. Thence North 73 Degrees 19 Minutes West along the South side of a field road a distance of 437.8 feet to a point marked by an iron pin; thence North 80 Degrees 26 Minutes West along the South side of a field road a distance of 125.5 feet to a point marked by an iron pin; thence South 02 Degrees 22.9 Minutes East a distance of 403.2 feet to a point marked by an iron pin; thence South 74 Degrees 19.2 Minutes East a distance of 546.1 feet to a point marked by an iron pin; thence North 00 Degrees 00 Minutes East a distance of 403.9 feet to the point of beginning. Said lot or parcel of land partially in the Northwest quarter of Southeast quarter and partially in the Southwest quarter of Southeast quarter of Section 30, Township 5 North, Range 15 East and containing 5.0 acres, more or less. Also, an easement and right of way across the following described property: All that part of the West half of the Southeast quarter lying East of the County Road and South of the point where the field road intersects the County Road; and all that part of the Northwest quarter of the Southwest quarter lying East of the County Road; all in Section 30, Township 5 North, Range 15 East. The hereinabove described real property is one and the same as the real property described in mortgage recorded in Book 952, Page 263, reformed by Court Order recorded in Real Prop Book 2016, Page 357; and deed recorded in Real Prop Book 917 Page 900; corrected by Scrivener’s Affidavit recorded in Real Prop Book 2015 Page 9647. .
